This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Lakhi Page No.# 2/3 Khanikar @ Ananta Khnaikar, has prayed for granting pre-arrest bail, apprehending arrest in connection with Amguri P.S. Case No. 22/2025, registered under Sections 109/118(2)/296/351(2)/351(3) of the BNS, 2023. 3. The informant Devirani Baruah wife of Santosh Baruah lodged an FIR dated 06.11.2025 against him with the allegation that on 01.11.2025 her husband and the petitioner, who is a meat shopkeeper had a small quarrel and thereafter, she heard him assaulting her husband on his head with a dao used for cutting meat; that, her husband was later hospitalized. 4. The learned counsel for the petitioner submits that there is no explanation in the ejahar about a few days delay in lodging the same. It is also submitted that with regard to an incident on 01.11.2025 at about 9:15 p.m. his wife has also lodged a FIR on the informant's husband through the Superintendent of Police but due to the apology of the Santosh Baruah, they did not proceed further. No case was also registered with regard to same. 5. The petitioner was granted interim bail on 17.12.2025. The learned Additional PP submits that in the meantime, upon completion of the investigation chargesheet has been submitted. 6. Mr. Dutta, learned counsel submits that petitioner has also received summons and a copy of the same is placed before this Court. 7. In view of the aforesaid developments, the interim granted on 17.12.2025, is hereby made absolute, subject to the following conditions Page No.# 3/3 that:- (i) he shall appear before the learned Court below; (ii) he shall cooperate with the trial; (iii) he shall not hamper or tamper with the evidence; (iv) he shall not intimidate /harass or harm the informant/victim side or try to influence any witnesses. 8. Violation of any bail conditions will entail cancellation of the bail. 9. Accordingly, this instant anticipatory bail application stands allowed and disposed of. 10. Send back the case diary.
