The Petitioner is before this Court seeking for the following reliefs: a) “To issue a Writ of Mandamus directing the 3rd Respondent to consider the Representation dated 28.11.2022 as per ANNEXURE-C and the Representation dated - 4 - HC-KAR NC: 2026:KHC:30043 WP No. 3437 of 2026 11.01.2024 to the 3rd Respondent as per ANNEXURE-D. b) To issue a Writ of Mandamus directing to Implement the recommendation letter dated 12.08.2025 issued by the 8th Respondent to 11th Respondent vide Ka.Em/KaNaVi/Nam- gudu/Bhu.Ma/2025-26 as per ANNEXURE-K by taking into consideration the report dated 02.09.2025 vide Hi.Sa.Tho.Ni/Zi.Pa/ Namgudu/Thasa/2025-26 as per ANNEXURE-G issued by the 5th Respondent. c) To Issue a Writ of Mandamus, directing the 11th and 12th Respondent to consider the representation dated 06.09.2025, given on 10.10.2025 as per ANNEXURE-L. d) To pass any other order or direction to the Respondents to consider the case of the Petitioner by paying the compensation within the time frame. e) To pass any other order or directions as deems fit by this Hon'ble Court.” 2. The grievance of the petitioner is that the representations dated 28.11.2022 at Annexure-C and 11.01.2024 at Annexure-D, the recommendation dated 12.08.2025 issued by respondent Nos.8 to 11 at Annexure-K, the report dated 02.09.2025 issued by respondent No.5 at Annexure-G and the subsequent representation of the petitioner dated 06.09.2025 at Annexure-L, have not been considered. - 5 - HC-KAR NC: 2026:KHC:30043 WP No. 3437 of 2026 3. Learned counsel for the Petitioner submits that all the above actions were in respect of the overflow of water into the property of the petitioner, which had an effect of destroying several trees as regards which compensation was sought for, some of which has been ascertained, some of which is yet to be ascertained. 4. The representations having been made by a citizen, some of which having been accepted by the concerned Authority, it was required for the Authority to implement the recommendation and make payment of the due amounts to the Petitioner, who being a farmer is adversely affected on account of destruction of crop and trees. Insofar as the remaining aspects, which are yet to be ascertained, those were to be ascertained and necessary orders passed as early as possible. The event having occurred in the year 2022, the same is yet to reach a - 6 - HC-KAR NC: 2026:KHC:30043 WP No. 3437 of 2026 culmination in the year 2026, which does not speak well for the State. 5. In that view of the matter, this Court passes the following: ORDER i) Writ petition is allowed. ii) Mandamus is issued directing respondent No.3 to consider the representations dated 28.11.2022 at Annexure-C and 11.01.2024 at Annexure-D. iii) The respondents are also directed to implement the recommendation dated 12.08.2025 of respondent No.8 to 11 at Annexure-K and the report of respondent No.5 at Annexure-G. iv) Insofar as the remaining items, respondent Nos.11 and 12 are directed to consider the representation dated 06.09.2025 submitted on 10.10.2025 at Annexure-L. - 7 - HC-KAR NC: 2026:KHC:30043 WP No. 3437 of 2026 v) All the above to be completed within a period of eight (8) weeks from the date of receipt of a copy of this order.
