S. No. 131 Suppl Cause List-1 IN THE HIGH COURT 0F JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) No. 1782/2026 CM No. 4753/2026 Nazir Ahmad Wani …Appellant(s)/Petitioner(s) Through: Mr. M. Ashraf Wani, Advocate Vs. UT of JK and others ...Respondent(s) Through: CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER 07.08.2026 1. This Court is afraid that it can’t lend indulgence on writ side jurisdiction in view of the judgement dated 29.08.2025 of the writ court in a clubbed petition with lead case WP (C) No. 1606/2023 in which the petitioner’s writ petition WP(C) No. 943/2023 was also figuring in the bunch getting disposal by reference to the status of Lumberdars in the office or out of office and a consequent direction upon the Government to come with the election under J&K Lumberdari rules. 2. The petitioner’s grievance in the writ petition is that the election process has not been taken to its logical end and in the process he is suffering denial and deprivation of remuneration despite being Lumberdar of village Amargarh Tehsil Sopore. 3. The grievance of the petitioner is of nature which cannot constitute a separate cause of action other than the cause for initiating contempt proceedings or any act of non-compliance on the part of the respondents herein to carry out the letter and spirit compliance of the judgement dated 29.08.2025 of the writ court in a clubbed petition with lead case WP (C) No. 1606/2023. 4. This writ petition is accordingly allowed to be withdrawn with liberty to the petitioner to invoke contempt proceedings. In case, upon availing the contempt jurisdiction, the answer to the petitioner would be that scope for contempt petition is not there then withdrawal of this writ petition will not come in the way of the petitioner to come back with the writ petition. 5. Dismissed as withdrawn along with the connected CM. (RAHUL BHARTI) JUDGE Srinagar 07.08.2026 “Imtiyaz” Imtiyaz Ul Gani I attest to the accuracy and authenticity of this document 11.08.2026 14:06
