Though the matter is listed today for preliminary hearing, it is heard. 3. This petition is filed seeking following reliefs: (i) Issue a direction to the respondent bank to register the sale certificate in respect of the schedule property pursuant on auction conducted on 09.07.2025 as Annexure-A in the name of the 4th petitioner Balaji Palani S/o A.Palani and to deliver the vacant possession of the schedule property. (ii) Grant such other relief's as this Hon'ble Court may deem fit in the facts and circumstances of the case. 4. Counsel for the petitioners submits that the petitioners are the legal heirs of Sri.A.Palani. 5. Heard, the contentions urged on behalf of the respective parties and perused the writ papers with utmost care. 6. Suffice it to note that the auction purchaser was Sri.A.Palani and a sale certificate was accordingly issued on 03.09.2025. However, he died on 07.03.2026 before the - 4 - HC-KAR NC: 2026:KHC:32927 WP No. 16419 of 2026 completion of the formalities of the registration of the property in his name. Hence, the legal heirs of Sri.A.Palani are before this Court seeking a direction to issue a sale certificate in their favor. 7. A perusal of Annexure B reflects that the Bank had issued the sale certificate in favor of Sri.A.Palani. He died subsequent to the issuance of the sale certificate and also before the completion of the formalities hence, there is no impediment for this Court to direct the bank to issue a sale certificate in favor of the petitioners/ the legal heirs of Sri.A.Palani within a period of two weeks from the receipt of certified copy of this order. 8. Accordingly, writ petition is disposed of. Because of disposal of the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of.
