This writ petition has been filed under Article 227 of the Constitution of India with the following prayers:- “(i) Issue a writ, order or direction to the 4th Additional District Judge, Dehradun to decide the Civil Appeal No.04 of 2023 titled as “Kushal Singh Bhandari vs. Smt. Anita Dabral” under Section 151 of the Civil Procedure Code, as early as possible within any stipulate time bound period. (ii) Issue a suitable writ, order or direction in favor of petitioner and against the respondents which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case. (iii) To award the cost of the present writ petition to the petitioner.” 2. Heard Mr. Bhuwan Bhatt, learned counsel for the petitioner. 3. Mr. Bhuwan Bhatt, Advocate, submitted that 1 2026:UHC:996 while granting the stay order on 06.01.2023, the learned Appellate Court imposed the condition that the appellant will not take any unnecessary adjournment. The said appeal is pending for arguments since 16.03.2023. 4. The said prayer is an innocuous prayer. 5. In the facts and circumstances of the case, the present writ petition is disposed of by directing the IVth Additional District Judge, Dehradun to conclude the proceedings of the Civil Appeal No.04 of 2023 as per law as expeditiously as possible and without granting any unnecessary adjournment to either of the parties. 6.
