Heard learned counsel for the parties. 2. The instant writ application has been preferred by the petitioner praying therein for the following reliefs: i. For issuance of an appropriate writ(s) / order(s) /direction(s) commanding upon the respondents, to immediately and forthwith revise the Pay Scale of the petitioner's father in the scale of 6500-10500 under 1st ACP, in light of Departmental Notification contained in Memo No. 2075 dt. 02.09.2024, passed in compliance of this Hon'ble Court's order and direction in W.P.(S) No. 889/2014 and as upheld by the Hon'ble Division Bench in L.P.A. No. 142/2018; ii. For issuance of an appropriate writ(s) / order(s) /direction(s) commanding upon the respondents to grant 2nd ACP to the Petitioner's father, in the scale of 10000-15200 w.e.f. the due date of eligibility, iii. Consequent upon the revision of the pay scale under 1st ACP and grant of 2nd ACP, the Petitioner further prays for issuance of an appropriate writ(s) / order(s) / direction(s) commanding upon the respondents to release the arrears of salary of his father arising out of difference of pay scale along with interest, iv. For issuance of an appropriate writ(s)/order(s) /direction(s) commanding upon the respondents to re-compute the pension and other retiral benefits of the Petitioner's father and release the arrears thereupon, as has already been allowed to similarly situated persons. 3. At the outset, learned counsel for the petitioner 2026:JHHC:26599 2 submits that suffice it would be if this writ petition is treated as representation of the petitioner and a direction be given to the respondents to pass a reasoned order within a stipulated period. 4. Learned counsel for the respondents submits that since no counter-affidavit has been filed on behalf of respondents; as such, petitioner may be directed to file fresh representation before the concerned respondents so that his grievance can be redressed. 5. Having regard to the aforesaid facts and circumstances and limited submissions of the learned counsel for the parties, the instant writ application is hereby disposed of by directing the 3rd Respondent to treat this writ application as representation and take a decision with regard to the claim made by the petitioner in accordance with law and applicable rules and regulations and also in the light of Annexure 3, 5 and 8, by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of a copy of this order. 6. It goes without saying that if the petitioner is found eligible, then necessary consequential order shall also be passed within a further period of 8 weeks. 7. Petitioner is directed to serve a copy of this writ application to the 3rd respondent so that his grievance can be redressed at the earliest. 8.
