04/07.09.2026 Heard Md. Yasir Arafat, learned counsel for the appellants and learned A.P.P. for the State.
This appeal is directed against the order dated 09.07.2026 passed by the learned Sessions Judge, Pakur in Bail Petition No. 181/2026 in connection with Pakur Muffasil P.S. Case No. 83 of 2026, whereby and whereunder, the prayer for regular bail of the appellants has been rejected.
It has been alleged that, on information that some persons were taking drugs and creating nuisance for the women of the village, a raid was conducted by the police, at which 40-50 persons had assembled and thrown bricks and stones at the police party.
Submission has been advanced by the learned counsel for the appellants that, so far as appellant no. 2 is concerned, he has been implicated as one of the person who was taking drugs. So far as appellant no. 1 is concerned, he appears to be one of the persons in the unlawful assembly who had thrown bricks and stones at the police party. Learned counsel adds that the appellants

are in custody since 02.07.2026 and the charge sheet has been submitted by the police.
Learned A.P.P. has opposed the prayer for bail of the appellants.
Regard being had to the fact that the charge sheet has been submitted and the nature of the allegation levelled against the appellants, we, while setting aside the
order dated 09.07.2026 passed by the learned Sessions Judge, Pakur in Bail Petition No. 181/2026, direct that the appellants be released on bail on furnishing a bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Pakur in connection with Pakur Muffasil P.S. Case No. 83 of 2026.
This appeal is allowed.
