For the State Affidavit of service filed on behalf of the petitioner is taken on record. None appears for the Panchayat despite service. The petitioner was issued work order by Suti I Panchayat Samity on 24th February, 2022 for construction of Individual Household Latrine. Estimate of construction of each latrine was Rs.12,000/-. The petitioner completed the work in due time and filed applications before the concerned authority on 18th December, 2023 and 23rd November, 2024 respectively for disbursal of the due amount of Rs.12,60,000/-. The applications have not been considered and the amount still remains due. Upon consideration of the submission made on behalf of the parties, this Court directs the Block Development Officer and Executive Officer, Suti I Panchayat Samiti, being the 4th respondent herein, to consider and dispose of the applications filed by the petitioner dated 18th December, 2023 and 23rd 2 November, 2024 respectively within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the concerned authority finds the petitioner entitled to the said amount, the same shall be disbursed in favour of the petitioner within one month thereafter. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
