No.2979 OF 2025 The Court made the following ORDER :- The present Civil Revision Petition is filed by the claimants under Article 227 of Constitution of India, assailing of non-disposal of E.A.No.19 of 2022 in E.P.No.81 of 2021 in A.R.C No.360 of 2019 on the file of the Court of VII Additional District Judge at Guduru of SPSR Nellore District. 2. Learned counsel for the petitioners submits that the petitioners filed E.A.No.19 of 2022 in E.P.No.81 of 2021 under Order XXI Rule 58 CPC claiming part of E.P. schedule property. He further submits that the Executing Court has ordered attachment of the property under Order XXI Rule 54 CPC by order, dated 10.03.2022. The grievance of the petitioners in this revision petition is that without adjudicating the said claim petition, the Executing Court is proceeding with the sale of the attached property pursuant to the docket order, dated 05.08.2025. On the other hand, Sri O.Udaya Kumar, learned counsel for the respondent No.1 does not dispute the factual matrix or the pendency of the proceedings before the Executing Court. 4.
