A mandamus is being sought for against the House Building Co-operative Society who has formed a layout and allotted sites. 3. The respondent is not a State, instrumentality of State or an authority discharging any public function to come within the purview of Article 12 of the Constitution of India. Hence, the mandamus as sought for cannot be granted reserving liberty to agitate his claims before the appropriate forum. 4. Petition is dismissed.
