Learned counsel for the applicant has preferred this petition for modification of the order dated 20.01.2026 passed by this Court in MCRC No.9970 of 2025 (Omprakash Gorkundey @ Gajju vs. State of C.G.) stating that this Court has directed to grant bail to the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.07.09 18:13:23 +0530 2 applicant furnishing a personal bond with two sureties, as has been mentioned in para 7 of the order. She further submits that so far as two sureties are concerned, the applicant has no sureties in Bilaspur because of financial hardship, due to which, he could not be released on bail even though he has been granted bail by this Court on 20.01.2026 and so far as the trial is concerned, only two prosecution witnesses have been examined by the trial Court. Summons have been issued to the remaining prosecution witnesses; however, despite service, they have not appeared before the trial Court. It is further noticed that the co-accused, namely, Raja Vastrakar, has already been enlarged on bail by this Court in MCRC No. 2301 of 2026 vide order dated 22.04.2026. Subsequently, as he was unable to furnish the condition of "a personal bond with two sureties" imposed in the said order, this Court, in CRMP No. 1399 of 2026, vide order dated 15.06.2026, modified the bail conditions and granted appropriate relief. Hence, she prays to grant him bail on furnishing a personal bond. 3. In view of the above, the “ a personal bond with two sureties” mentioned in para 7 of the order dated 20.01.2026 in MCRC No.9970 of 2025 is modified to the extent of “a personal bond with two sureties ”. 4. Accordingly, the present CRMP is allowed. 5. The order dated 20.01.2026 passed by this Court be modified as mentioned above. 6. A copy of this order be placed in the record of MCRC No.9970 of 2025.
