Accused in Crime No.292/2025 registered by Ramanagara Rural Police Station, Bengaluru South District, for the offences punishable under Sections 64, 88, 308(6), 318(4), 108 of BNS, 2023, and Section 67 of Information Technology Act, 2000, is before this Court in ths petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.292/2025 was registered by Ramanagara Rural Police Station, Bengaluru South District, initially for the offences punishable under Sections 108, 64, 318(4), 88 of BNS, 2023, and Section 67, 66(E) of Information Technology Act, 2000, as against the petitioner herein based on the first information dated 08.12.2025 received from Smt. Geetha - mother of deceased Varshini. In the said case, petitioner was arrested on 09.12.2025 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.239/2026 was rejected on 15.05.2026. Therefore, petitioner is before this Court. - 3 - HC-KAR NC: 2026:KHC:33074 CRL.P No. 7544 of 2026 4. Perusal of the material on record would go to show that the petitioner and the victim girl were in relationship. The allegation in the first information as well as in the charge sheet is that, petitioner with a false promise to marry the victim had sexual intercourse with her and as a result she became pregnant. Subsequently, the pregnancy was terminated at the instance of the petitioner. It is also alleged that petitioner by black-mailing the victim girl, used to often collect money and gold jewellery from her. It is further alleged in the charge sheet, that when the victim girl had contacted the petitioner over mobile phone and had requested him to marry her, he allegedly had criminally intimidated her and had asked her to go and die. The victim girl had committed suicide by hanging herself on 07.12.2025 leaving behind a death note stating that the petitioner was the cause for her death. 5. Neither in the FIR nor in the charge sheet, there is any mention about the act committed by the petitioner immediately prior to the victim committing suicide, which had instigated her to take the drastic step of committing suicide. Petitioner is in custody from 09.12.2025 onwards. Investigation of the case is - 4 - HC-KAR NC: 2026:KHC:33074 CRL.P No. 7544 of 2026 completed and charge sheet has been filed. The alleged offences are not punishable with death or life imprisonment. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.292/2025 registered by Ramanagara Rural Police Station, Bengaluru South District, for the offences punishable under Sections 64, 88, 308(6), 318(4), 108 of BNS, 2023, and Section 67 of Information Technology Act, 2000, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR NC: 2026:KHC:33074 CRL.P No. 7544 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
