JUSTICE PRAVEER BHATNAGAR Order 24/04/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.31/2026 registered at Police Station Govindgarh (Alwar), District Alwar for the offence(s) under Sections 319(2), 318(4), 316(2) and 112(2) of BNS and Section 66D of IT Act. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is alleged against the petitioners that they were involved in creating misleading advertisement on their mobile phone and extorted money from many persons. It is also mentioned in the charge- [2026:RJ-JP:17504] (2 of 3) [CRLMB-3150/2026] sheet that 7 complaints were registered in Cyber portal against the Sim card, however, the police during investigation did not examined the complainants who made complaint on the Cyber portal. It is also contended that in the charge-sheet, it is not stated that the amount obtained through Cyber offence were deposited in the petitioner's accounts, there are no criminal antecedents against the petitioners and charge-sheet has already been submitted and trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail application. 4. Heard and perused the material available on record. 5. It emerges from the record that many complaints against the Sim cards, used by the petitioners have been lodged in the Cyber portal; however, the police has not examined the complainants who reported the matter on the Cyber portal, the police has also not collected the evidence that whether any amount was transferred in the petitioner's account, there are no criminal antecedents against the petitioners, the accused-petitioners are in custody since long, the charge-sheet has already been submitted and trial of the case may take considerable time, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Jursed S/o Shri Mallu Khan and 2. Sahil S/o Shri Asraf [2026:RJ-JP:17504] (3 of 3) [CRLMB-3150/2026] Khan, in connection with FIR No.31/2026 registered at Police Station Govindgarh (Alwar), District Alwar, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
