ORAL ORDER
(PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainants have filed the present complaint alleging willful disobedience of an order dated 10.08.2023 passed by a Co-Ordinate Bench of this Court on I.A. No.1/2018 in RFA No.1267/2018.
2. Accused Nos.1 to 3 had filed the said appeal and had also sought an interim order of injunction, restraining the complainants or anyone claiming under them to alienate or encumber the subject properties, which were described as under:
"SCHEDULE PROPERTY
(a) All that piece and parcel of the property bearing Khaneshumari No.180, Khatha No.260, new Municipal No.77, PID No.68-92-77, measuring East to West 45 feet and North to South 62 feet situated at Jakkasandra, 1st B Main, Begur Hobli, Bangalore South Taluk coming within Ward No.68 of BBMP, Bangalore 34 and bounded on:
East by - Yellamma's Property,
West by - Road,
North by - Site No.77/1, and
South by - Site No.76
(b) All that piece and parcel of the property bearing Khaneshumari No.181, Khatha No.262, new Municipal No.77/1, PID No.68-92-77/1, measuring East to West 45 feet and North to South 60 feet situated at Jakkasandra, 1st

B Main, Begur Hobli, Bangalore South Taluk coming within Ward No.68 of BBMP, Bangalore 34 and bounded on:
East by - Yellamma's Property,
West by - Road,
North by - Site No.77, and
South by - Site No.78"
3. The order dated 10.08.2023 indicates that the accused had stated that they were not in possession of the subject property.
4. The complainants allege that, despite the status quo
order as to possession, the accused have raised construction on the subject property. It is stated that accused No.4 is now in possession of the same.

Learned counsel appearing for accused No.4 submits that he is not a party to the RFA and he acquired the title to the property from one B.T. Thimmaraju, who, in turn, acquired the property in the year 2018. The learned counsel for the accused also submits that the description of the property acquired and raised by accused No.4, is distinct from scheduled property in respect to which the injunction has been granted.

6. At this stage, the learned counsel for the complainants seeks to withdraw the present complaint with liberty to seek appropriate substantive remedies.
7. In view of the above, the complaint is dismissed as withdrawn with liberty as prayed for.
