D/L.71 Rakib (Allowed) CRM (NDPS) 356 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kumarganj Police Station case no. 118 of 2025 dated 28.03.2025 under Sections 21(c)/22(c)/23(c)/27A of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Jahangir Alam & Anr. ……Petitioners. Mr. Kaushik Chowdhury Mr. Dwaipayan Panda Mr. Tridib Das ……for the Petitioners. Ms. Sreyashee Biswas Ms. Pushpita Saha ……for the State. Learned advocate for the petitioners submits that the petitioners are in custody for about 11 months and subject matter of recovery in the present case is 149 bottles of phensedyl. Learned advocate for the State opposes the prayer for bail and submits that 9 witnesses have already been examined and the prosecution would examine few more witnesses. Be that as it may, I find presently in the charge-sheet 21 witnesses have been relied upon. Having considered the quantum of recovery, the period of detention and the stage of the case, I am of the view that further incarceration of the petitioners is unwarranted. As such, the prayers for bail of the petitioners are allowed. As such, petitioners namely, Jahangir Alam and Abdur Rahaman shall be released on bail upon furnishing bond of Rs. 2 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act cum learned Additional Sessions Judge, 3rd Court, Dakshin Dinajpur. If on bail, the petitioners shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Dakshin Dinajpur without prior permission of the learned Special Court. Accordingly, the prayer for bail in CRM (NDPS) 356 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
