Learned advocate for the petitioner submits that neither there is any motive which has been expressed by the prosecution in the charge-sheet nor there are materials to substantiate that the petitioner could have been the only person who is responsible for the murder of the deceased. Learned advocate for the State opposes the prayer for bail and relies upon the post-mortem report. There are CCTV footages also. According to the prosecution, the materials which have been collected by the investigating agency do suggest last seen theory of the petitioner with the deceased. 2 Having regard to the stage of the case and considering the report of the expert in respect of the CCTV footages, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. The Superintendent of Police, Murshidabad Police District will communicate with the Director of Forensic Science Laboratory for expediting the receipt of the report in respect of the CCTV footages. Accordingly, CRM(M) 412 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record.
