Present is a second bail application of the applicant who has been arrested on 16.03.2026 in connection with Crime No. 132/2026 registered at Police Station – Kotwali, District – Durg (C.G.) for the offence under Section 3(2) of the Chhattisgarh Gambling Prohibition Act, 2022 and Section 112(2) of the Bharatiya Nyaya Sanhita, 2023. 4. Learned counsel for the applicant would submit that the first bail application of the applicant was filed in the name of Khemraj Deshmukh in MCRC No. 3978/2026 but during hearing of the first bail application of the applicant alongwith the bail applications of other co- accused persons, it was transpired that the actual name of Khemraj Deshmukh was Ballu Verma @ Kallu Verma @ Khemraj Deshmukh and on that premises, he withdrawn the bail application on behalf of Khemraj Deshmukh vide order dated 14.05.2026 and on that day, the bail applications of the other co-accused persons have been allowed by this Court. Since the bail application of the present applicant Khemraj Deshmukh was withdrawn, he again approached before the learned trial Court by filing afresh bail application in his correct name and after its rejection on 20.05.2026, he filed the present second bail application in the name of Ballu Verma @ Kallu Verma @ Khemraj Deshmukh. He would also submit that Khemraj Deshmukh and Ballu Verma @ Kallu Verma @ Khemraj Deshmukh are one and the same person who has been arrested in the case alongwith other co-accused persons. He would also submit that the similarly situated co-accused persons have been released on bail vide order dated 14.05.2026 passed by this Court in MCRC No. 3091/2026, MCRC No. 3689/2026, 3 MCRC No. 3404/2026 and MCRC No. 4446/2026 and the case of the present applicant is also similar to those applicants who have been released on bail vide order dated 14.05.2026. He would further submit that from the present applicant total Rs.11,500/- cash have been seized and there is no criminal antecedent against the applicant, the applicant was alleged to have been engaged in playing card gambling alongwith other co-accused persons and the alleged offences are triable by the Judicial Magistrate First Class, charge-sheet has been filed and final adjudication of the case will take it sometime, therefore, he may be enlarged on bail. 5. On the other hand, learned counsel for the State opposes on merits, however, he is not disputing the correct name of the present applicant as Ballu Verma @ Kallu Verma @ Khemraj Deshmukh and the same has been mentioned in the arrest memo of the present applicant also. He would also submit that there is no criminal antecedent against the applicant as has been informed by the concerned police station and the case of the present applicant is also similar to the other co-accused persons who have been released on bail vide order dated 14.05.2026. 6. I have heard learned counsel for the parties and perused the material annexed with the bail application as well as gone through the case diary. 7. Considering the submissions made by learned counsel for the parties, considering the nature of allegation, material collected during the investigation, further considering that the applicant is in jail since 16.03.2026, his first bail application has been withdrawn on the ground that his name has been incorrectly mentioned in the earlier bail 4 application and subsequently, he revived his prayer for bail before the learned trial Court in his correct name, there is no criminal antecedent against the applicant, the similarly situated co-accused persons have already been granted bail by this Court vide order dated 14.05.2026 and the final adjudication of the case will take it sometime, I am inclined to release the present applicant Ballu Verma @ Kallu Verma @ Khemraj Deshmukh on bail. 8. Accordingly, the bail application of the present applicant Ballu Verma @ Kallu Verma @ Khemraj Deshmukh is allowed. 9. It is directed that the applicant Ballu Verma @ Kallu Verma @ Khemraj Deshmukh shall be released on bail on his furnishing a personal bond in the sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, on following conditions :- (i) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (ii) He shall not act in any manner which will be prejudicial to fair and expeditious trial. (iii) He shall appear before the trial Court on each and every date given to him by the concerned trial Court till disposal of the trial. Sd/- (Ravindra Kumar Agrawal) JUDGE Sumit
