JUSTICE RAVI V HOSMANI ORAL ORDER Seeking for quashing of proceedings in FIR No.9/2019 registered by Belagavi City CEN Crime Police Station, which is pending before Court of JMFC-III, Belagavi, and are stated to have been transferred to AHTU, Crime Investigation Department, Bengaluru, this petition is filed. 2. Sri Manikantha J, learned counsel appearing for respondent no.2 submitted that during pendency of matter, proceedings were disposed of on 15.03.2022 as settled. However, due to non-compliance with terms of settlement, an application for recalling and restoration of - 3 - HC-KAR NC: 2026:KHC:32892 WP No. 5573 of 2022 order dated 15.03.2022 was filed. Same was allowed on 26.03.2024. It was submitted that petitioners were due a sum of more than Rs.19,00,000/-, which remained unpaid despite lapse of sufficient period of time. Counsel for respondent no.2 therefore submits that there would be no justification for adjourning matter and seeks for dismissal. 3. None appears for petitioners and despite grant of time, office objections on main matter are not complied. This would indicate that petitioners are not pursuing matter diligently.
