Order No.03 Dated-08-09-2026
Heard the parties.
The petitioner has been made accused in connection with S.T. Case No.687 of 2025 arising out of Bankmore P.S. Case No.05 of 2021 registered under Section 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed theft of a Motor from B.C.C.L. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner is a habitual jumper of bail and on four previous occasions, he has jumped the bail and he has not co-operated with the trial but this time, the petitioner undertakes to co-operate with the trial. It is lastly submitted that the petitioner has been in custody since 29.04.2026. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the conduct of the petitioner of absconding whenever he was released on bail on four earlier occasions, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail.
Considering the serious nature of allegation against the petitioner and his conduct of absconding whenever he was released on
bail on four previous occasions, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail.
Accordingly, the prayer for bail of the above-named petitioner is rejected.
