This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.16/2026, registered at Police Station Vishrampuri, District- Kondagaon (CG) for the VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.09 16:22:17 +0530
2 offence punishable under Section 74, 296, 75(1)(i)(ii), 79, 3(5) of BNS and Section 8 of POCSO Act. 2. As per prosecution case, the school girls had complaint to Child Help Line 1098 that Headmaster and Cook, who come to school everyday under the influence of alcohol with wrong intentions, put their hands on the chests of the girl students, hold their arms, use obscene language and indulge in obscene acts. On the basis of report, police registered the offence against the applicants. Investigation commenced and during the course of investigation, applicants were arrested on 14.03.2026. 3. Learned counsel for the applicants contended that the applicants have been falsely implicated in the present case. He further contended that even the victims have also not supported the case of prosecution and the applicants are in jail since 14.03.2026, and the trial will take considerable time for its conclusion, therefore, the applicants may be released on bail. 4. Learned State counsel opposes the submission made by learned counsel for the applicants and would submit that there are five victims girls in this case and at the time of incident, age of the victims was about 13-14 years. She further submits that in their Court statements, the victims girls have stated that the applicants have used to obscene words against the victim girls, trying to
3 touch them with bad intentions and used to show obscene photo/video to the victim girls.
She further stated that the victims are reported to the Child Help Line, 1098, therefore, the offence was registered against the applicants and also submits that the other prosecution witnesses are remain to be examined, therefore, the applicants may not be released on bail. 5. Pursuant to order dated 05.05.2026 passed by this Court, victims are appeared before this Court through virtual mode from the DLSA- Kondagaon. On being asked, they have no objection for grant of bail to the applicants. 6. I have heard learned counsel for the parties. 7. Considering the facts and circumstances of the case, material available on record, trial is going on and some prosecution witnesses are remain to be examined and looking to the nature and gravity of the offence, this Court is not inclined to grant bail to the applicants. 8. Accordingly, the bail application of the applicants stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for information.
