JUSTICE P SREE SUDHA ORAL ORDER This petition is filed by wife for transfer of M.C.No.142/2024 filed by husband for restitution of conjugal rights, from the Senior Civil Judge and JMFC, Channarayapatna, to transfer the same to the Principal Family Court, Mysuru, in which the petitioner’s petition in Crl.Misc.No.782/2024 is pending. - 3 - HC-KAR NC: 2026:KHC:32392 CP No. 69 of 2025 2. Heard learned counsel for petitioner. Notice sent to the respondent returned with endorsement “Refused” and hence it is treated as a proper service. 3. Learned counsel for the petitioner stated that the petitioner is working as a teacher in Mysuru and respondent is also working as a driver cum conductor in KSRTC Mysuru, but he filed this petition before Channarayapatna only to trouble her. Petitioner is having minor child aged 3 years and she is residing with her parents at Mysuru. The distance between Channarayapatna and Mysuru is 88 kilometres. It is stated that it is inconvenient for her to travel all the way and thus requested for transfer. 4. Considering the arguments of the petitioner counsel, in the absence of respondent, this Court finds that it is just and reasonable to transfer M.C.No.142/2024 from the Senior Civil Judge and JMFC, Channarayapatna to the Principal Family Court, Mysuru. The petitioner has also - 4 - HC-KAR NC: 2026:KHC:32392 CP No. 69 of 2025 filed Crl.Misc.No.782/2024 for maintenance before Principal Family Court, Mysuru and it is still pending.
