In this petition, the petitioner is challenging the order dated 18th December, 2025 (Annexure-C) passed by the respondent No.2-Deputy Commissioner in Case No.RP/4/2025. 3. Heard Sri. R.B. Sadashivappa, learned counsel appearing for the petitioner; Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to - 3 - HC-KAR NC: 2026:KHC:31995 WP NO.3544 OF 2026 3; and Sri. Murali B.S., learned counsel appearing for the caveator/respondent No.4. 4. Having heard the learned counsel appearing for the parties and on careful consideration of the finding recorded by the respondent No.2-Deputy Commissioner in the impugned order dated 18th December, 2025 (Annexure-C), it is forthcoming that the petitioner and the respondent No.4 herein are claiming right over the property based on two Wills and two Probates. It is also forthcoming from the averments made in the writ petition that the respondent No.4 has filed Original Suit No.220 of 2019 and on the other hand, the petitioner herein has filed Original Suit No.88 of 2022 before Senior Civil Judge and JMFC., Doddaballapur, seeking relief of declaration in respect of the subject land. In that view of the matter, I am of the view that the rights of the parties over the subject land is yet to be crystalised in the aforementioned pending suits.
