JUSTICE E.S.INDIRESH ORAL ORDER Heard Sri. R. Subramanya learned Counsel appearing for Sri. Galava Kumar M.V., appearing for the petitioner and Sri. Spoorthy Hegde N, learned High Court Government Pleader appearing for the respondent-State. 2. In the present writ petition, the grievance of the petitioner is that respondent Nos. 6 and 7 have failed to consider the representation dated 19.06.2023 (Annexure-G), wherein the petitioner has sought entry of the Janti Khata in the names of the petitioner and his mother, in terms of the order passed by this Hon'ble Court in W.P. No. 5784 of 2022. 3. Sri. R Subramanya, learned counsel for the petitioner, submits that the issue has already been - 5 - HC-KAR NC: 2026:KHC:32650 WP No. 29520 of 2025 adjudicated in the civil proceedings in O.S. No. 79 of 1989 and R.A. No. 7 of 1999 before the competent Civil Court, wherein the claim of the petitioner was upheld. In view of the said judgments and decree, the names of the petitioner and his mother are required to be entered in the khatha records. 4. It is also to be noted that respondent No. 7, by letter dated 21.09.2023 (Annexure-J), addressed to respondent No.6, has recommended mutation/change of khata in favour of the petitioner in terms of the judgments and decree passed by the competent Civil Courts. Therefore, the learned counsel for the petitioner, placing reliance on Section 128 of the Karnataka Land Revenue Act, 1964, contends that there is no legal impediment to entering the names of the petitioner and his mother in the revenue records/khata, as the competent Civil Court has - 6 - HC-KAR NC: 2026:KHC:32650 WP No. 29520 of 2025 conclusively recorded findings in respect of the land in question in favour of the petitioner. 5. The learned Additional Government Advocate sought to justify the action of the respondents and submitted that respondent No. 7 would take an appropriate decision in the matter in accordance with law. 6. In the light of the submissions made by the learned counsel appearing for the parties, and upon careful consideration of the judgment and decree passed in O.S. No.79/1989 dated 18.12.1998, wherein the rights of the petitioner in respect of the land in question were declared, which came to be confirmed in R.A. No. 7/1999. It is further evident that the judgment and decree passed by the Trial Court, as confirmed by the First Appellate Court, were also affirmed by this Court in RSA No. 8/2005 by judgment - 7 - HC-KAR NC: 2026:KHC:32650 WP No. 29520 of 2025 dated 02.06.2011 (Annexure-D), and this Court is of the considered opinion that the petitioner is entitled to have his name entered in the relevant revenue records. 7. In that view of the matter, a writ of mandamus is issued directing respondent No.7- Thasildar to enter the name of the petitioner in the relevant revenue records/khata, as required under Section 128 of the Karnataka Land Revenue Act, 1964, within an outer limit of one month from the date of receipt of a certified copy of this order.
