The present reference has been made by the learned Judicial Magistrate under Section 15(2) of the Contempt of Courts Act, 1971 for initiation of contempt proceedings against the alleged contemnor, Shri Daulat Ram Sonkar. From the reference, it transpires that in an application filed by the alleged contemnor in Civil Suit No. 28A/2024, certain derogatory and scandalous allegations were made against the then Presiding Officers of the Court, namely Shri Pankaj Jain, Shri Pankaj Dixit and Shri Mahesh Babu Sahu. Taking note of the language employed in the application, the present Presiding Officer issued a show-cause notice to the alleged contemnor. 5. In response to the said notice, the alleged contemnor submitted his reply and tendered an unconditional apology, stating that he is a less educated person and that the objectionable expressions had been used inadvertently and without any intention to lower the dignity of the Court or to scandalize the Judicial Officers. 6. It is pertinent to note that the allegations in question were directed against the then Presiding Officers of the Court. However, none of the Judicial Officers against whom such allegations were allegedly made considered it appropriate to make any reference for initiating proceedings under the Contempt of Courts Act. The present reference has been made by the successor Presiding Officer after taking cognizance of the alleged contemptuous conduct. 7. Having considered the entire material placed on record, this Court is of the opinion that, in the facts and circumstances of the case, no case is made out for taking further action on the present reference. The 3 alleged contemnor has already tendered an unconditional apology, and no exceptional circumstance is found warranting initiation of contempt proceedings by this Court. Accordingly, this Court is not inclined to proceed further on the reference. 8. Consequently, the reference made under Section 15(2) of the Contempt of Courts Act, 1971, is rejected. However, the alleged contemnor is hereby put to strict caution regarding his future acts and conduct, failing which it shall be open to the concerned Court to initiate contempt proceedings against him in accordance with law. 9. Let a copy of this order be transmitted to the learned Judicial Magistrate concerned as well as to Daulat Ram Sonkar, the alleged contemnor, through the Registrar (Judicial), for information and necessary action.
