Instant Criminal Revision is directed against the judgment dated 30.07.2015 passed by learned Addl. Sessions Judge-XI, Dhanbad in Criminal Appeal No. 01 of 2011, whereby and whereunder the learned Appellate Court has dismissed the appeal filed by the petitioner against the judgment of conviction and order of sentence dated 07.12.2010 passed by learned Judicial Magistrate, 1st Class, Dhanbad in C.P. Case No. 974 of 2005 / T.R. No. 515 of 2010, whereby and whereunder the petitioner has been held guilty for the offence under Section 138 of the N.I. Act and has been sentenced to undergo S.I for 6 months and further directed to pay sum of Rs. 2,17,000/- (rupees two lakh seventeen thousand) as compensation to the complainant 3. Learned counsel for the petitioner submits that he has already deposited a draft of Rs. 2,17,000/- dated 12.12.2024 in the office of learned Registrar General, High Court of Jharkhand and the same has 2026:JHHC:26748 2 | P a g e also been revalidated by complying the order of revalidation of cheque vide order dated 13.07.2026. It is further submitted that both the parties have appeared before the DLSA, Dhanbad and a report has also been submitted by DLSA, Dhanbad showing the mediation between the parties successful on 27.08.2026 and the parties have amicably resolved their dispute. The total amount of Rs. 2,17,000/- involved in this case has been received by the complainant as full and final satisfaction of is claim. Both the parties have signed on the agreement alongwith their respective counsel. 4. Learned counsel for the opposite party no. 2 has not disputed the aforesaid submissions raised by the learned counsel for the petitioner. 5. It appears that a report has also been received in this Court sent by the Secretary, DLSA, Dhanbad vide Letter No. 55/2026 dated 27.08.2026 showing the mediation successful between both the parties. 6. In view of the amicable settlement between the parties and the case being compoundable in nature, the judgment of conviction and sentence of the appellant passed by the learned Trial Court and affirmed by the learned Appellate Court is hereby set side. The petitioner is acquitted from the charge levelled against him. 7. The opposite party no. 2 is permitted to withdraw the amount of Rs. 2,17,000/- (rupees two lakh seventeen thousand) deposited in the office of Registrar General, High Court of Jharkhand, after proper verification. 8. Accordingly, this revision is disposed of. 9. Pending I.A.(s), if any, also stands disposed of. 2026:JHHC:26748 3 | P a g e 10. It appears that the petitioner is on bail. As such, he is discharged from the liability bail bond and sureties are also discharged. 11.
