1. There is no representation on behalf of the petitioner.
2. The petitioner is facing trial before the Court of learned Principal Sessions Judge, Budgam in FIR No.363/2023, allegedly for the commission of offence under Section 302 IPC.
3. During the pendency of the trial, the petitioner appears to have filed an application seeking his enlargement on bail, however, on account of his continuous absence for two hearings, the said application was dismissed for non-prosecution.
4. It is seen that instead of moving an appropriate application for revival of bail application or to take a legal recourse as available before the learned Trial Court, the petitioner has circumvented the proceedings and straightway approached this Court without any legal justification.
5. Accordingly, this Bail Application is dismissed. The petitioner, however, shall be at liberty to move the Trial Court with appropriate motion for revival of the bail application which was dismissed in default, if so advised.
