Learned counsel for respondent is absent. 2. Though this matter has come up for admission, it is taken up for final hearing and disposed of by this order. 3. This transfer petition is filed by husband for transfer of MC.No.37/2026 filed by wife for restitution of conjugal rights before the Principal Judge, Family Court at Tumakuru to the Family Court at Bengaluru. 4. Learned counsel for the petitioner has stated that the respondent is also working and residing in Bangalore and her parents are residing in Tumakuru which is at a distance of 70 Kms, as such she filed case at Tumakuru. The respondent filed complaint against the petitioner and also against his family members in Crime No.64/2024 for the offences under Sections 498-A, 504, 506 read with Section 34 of Indian Penal Code, 1860 and Sections 3 and 4 of Dowry Prohibition Act, 1961, against which he preferred Crl.P.No.13317/2024 before this Court and stay was granted against the other family members, as such charge sheet is filed against him. The petitioner stated - 3 - HC-KAR NC: 2026:KHC:32564 CP No. 94 of 2026 that, he is the only son and has to take care of his mother, as such he has difficulty to travel for Tumakuru. Previously he was working in Bharat Electronics Company Limited, he lost his employment after criminal case is lodged and there is threat to his life for attending the case at Tumakuru. 5. Learned counsel for the respondent has not turned up. 6. Considering the reasons stated by the learned counsel for petitioner, this Court finds it is reasonable to transfer MC.No.37/2026 from the file of the Principal Judge, Family Court at Tumakuru to the Family Court at Bengaluru and dispose of the matter.
