JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent Nos.1 and 2. 2. Petitioners are before this Court seeking for the following reliefs: "i. Issue a writ in the nature of Mandamus or any other appropriate writ directing Respondent No.1 to recognize and give effect to the Petitioners' ownership and hypothecation rights as evidenced by the representation dated 02.03.2026 (Annexure-D) and to process transfer/update of registration records of the said vehicles in accordance with law. ii. Issue a writ in the nature of Mandamus or any other appropriate writ directing Respondent No.2 to consider and decide the Petitioners' representation dated 02.03.2026 (Annexure-D) by passing a reasoned speaking order within a time bound period. iii. Issue a writ in the nature of Mandamus or any other appropriate writ directing Respondent No.1 & 2 to complete necessary statutory action on priority basis, considering that the subject vehicles are electric vehicles requiring continuous operation and maintenance to prevent deterioration and further loss. - 4 - HC-KAR NC: 2026:KHC:31776 WP No. 12179 of 2026 iv. The short grievance of the petitioners is that the representation submitted by the petitioners on 02.03.2026 (Annexure-D) to give effect to the alleged ownership of the petitioners and the hypothecation rights of the petitioners have not been given effect to by the respondents. 4. Whenever any application or representation is submitted to a authority, it is required for the said authority to consider the said application and passed necessary orders within a reasonable period of time either accepting or rejecting the representation made. 5. Needless to say, if an order of rejection is made it needs to be accompanied by reasons. 6. In the present case, the representation has been filed on 02.03.2026 and no order has been passed till now cannot be said to be reasonable. - 5 - HC-KAR NC: 2026:KHC:31776 WP No. 12179 of 2026 7. As such, this court passes the following: ORDER. (i) Writ petition is allowed. (ii) Respondents are directed to consider the representation of the petitioners dated 02.03.2026 in terms of Annexure-D and pass necessary orders within a period of 60 days from the date of receipt of a copy of this order. (iii) It is made clear that this Court has not expressed any opinion on the entitlement of the petitioners. The same would have to be determined by the respondents in accordance with law.
