Accused nos.1 and 3 in Crime No.144 of 2026 registered by Belur Police Station, Hassan District for offences punishable under Sections 352, 74, 118(1), 351(2), 109 & 190 of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the petitioners and learned Additional State Public Prosecutor on behalf of the respondent - State. 3. FIR in Crime No.144 of 2026 was registered by Belur Police Station, Hassan District, initially for offences punishable under Sections 352, 74, 118(1), 351(2) and 190 of BNS, 2023 against petitioner no.1 herein and five others. Apprehending arrest in the said case, petitioners herein who are arrayed as accused nos.1 and 3 in the FIR had filed - 3 - HC-KAR NC: 2026:KHC:33029 CRL.P No. 9234 of 2026 Crl.Misc.No.574 of 2026 before the jurisdictional Sessions Court which was rejected on 16.06.2026. Therefore, they are before this Court. 4. The material made available to this Court by the learned counsel for petitioners would go to show that, in respect of the alleged incident that had taken place on 19.05.2026 at about 20.45 hours, a case and counter case has been registered in Crime No.144 of 2026 and Crime No.145 of 2026 by Belur Police Station on the evening of 20.05.2026 between 17.00 hrs and 17.30 hrs. 5. Perusal of the first information in the aforesaid two criminal cases would go to show that, accused persons in both cases are residing in adjacent houses and on 19.05.2026 at about 20.00 hours, they had fought against each other on some petty issue. 6. Perusal of FIR registered in both the cases would go to show that, the injured victims in both the cases have suffered only simple injuries. The victims in the present case are accused in Crime No.145 of 2026. Therefore, it is apparent that they had not sustained any grievous injuries on any vital part of their body. Petitioners herein are husband and wife and they are said to have no other criminal antecedents. They have undertaken to cooperate with the police for the purpose of investigation. 7. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.144 of 2026 registered by Belur Police Station, Hassan District for offences punishable under Sections 352, 74, 118(1), 351(2), 109 & 190 of BNS, 2023 subject to the following conditions: 1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal - 5 - HC-KAR NC: 2026:KHC:33029 CRL.P No. 9234 of 2026 bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
