2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 319(2), 318(4), 316(2) of Bharatiya Nyaya Sanhita, 2023 and 66, 66C, 66D of Information Technology Act.
3. It is a case of cyber fraud in which total Rs. 20 lacs was debited by accused person by sending a link on the mobile phone of the informant, out of which Rs. 5 lacs was credited to the account of the petitioner.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on suspicion. Petitioner is not owner

5. Learned counsel for the State opposed the prayer for bail. Counter affidavit has been filed on behalf of Superintendent of Police, Vaishali at Hajipur. It has been stated that Rs. 5 lacs of the aforesaid fraud money has been credited in the account of the petitioner. Besides this, petitioner was seen withdrawing the money at the relevant time in the CCTV of the concerned ATM.
6. Considering the nature and gravity of accusation, prayer for bail of the petitioner is rejected.
