This writ petition under Article 226 of the Constitution of India has been filed by the petitioner against the impugned order dated 3 25/02/2021 (Annexure P-1) passed by the Collector, Ambikapur, District Sarguja in Revenue Case No. 17/B-121/2020-2021. 2. Learned counsel for the petitioner would submit that the Collector, Ambikapur could not have assumed jurisdiction and passed the order of award granting payment of approximately Rs. 2.94 crores in favour of respondents No. 5 to 11, therefore, the impugned order (Annexure P-1) is liable to be set aside. 3. Learned senior counsel for respondents No. 5 and 6 would submit that the dispute existing between the parties is a contractual dispute and an arbitration clause exists in the agreement, therefore, this writ petition may be disposed of by directing the parties to avail the remedy available under clause 8 of the agreement executed between the petitioner and the private respondents. 4. Learned State counsel would submit that pursuant to the order dated 20/07/2020 passed by this Court in WPC/1582/2020, Collector was directed to hear both the parties and thereafter, take a decision in accordance with law. 5. I have heard learned counsel for the parties, considered their submissions made herein-above and perused the records. 6. Though this Court, vide order dated 20/07/2020 passed in WPC/1582/2020, had directed the Collector to verify the facts of the case from both the parties and thereafter, pass an order in accordance with law, but it appears that the dispute between the parties is a contractual one as it relates to payment made against 4 the borrowed vehicles. As such, for resolving such a dispute, there is an arbitration clause in the agreement executed between the parties being clause No. 8 which provides for redressal of dispute between the parties through arbitration. 7. In that view of the matter, the impugned order dated 25/02/2021 (Annexure P-1) passed by the Collector, Ambikapur, District Sarguja in Revenue Case No. 17/B-121/2020-2021 is hereby set aside and parties are at liberty to invoke the arbitration clause in accordance with the terms of the agreement, absolutely in accordance with law. 8.
