ORAL ORDER The petitioner is before this Court seeking grant of anticipatory bail under Section 438 of Cr.P.C./482 of BNSS in Crime No.85 of 2025 of CEN Police, Chikkamagaluru, registered for the offences punishable under Sections 59, 306, 316(5), 318(4), 336(2), 336(3), 338, 340(2), 339, 61(2)(b) read with 3(5) of BNS, 2023, for it having been turned down by the learned Sessions Judge in Crl.Misc.No.374 of 2025.
2. Heard Sri K S Ganesha, learned counsel appearing for the petitioner and Smt B Pushpalatha, Additional SPP appearing for the respondent-State.

Facts in brief, germane, are as follows: The petitioner is an erstwhile employee of the Central Bank of India. Owing to certain omissions and commissions, the petitioner was prosecuted by the Bank by registering a crime. - 3 -

Pursuant to the registration of crime, the petitioner was taken into custody. The police did not file its charge sheet within 60 days as was required under Section 187(3) of BNSS, as the offences alleged against the petitioner were all punishable with maximum imprisonment of 7 years. 4. It transpires that the concerned Court, pursuant to his arrest and default of the prosecution in filing the charge sheet within 60 days as obtaining under Section 187(3) grants him default bail. The petitioner then comes out of custody. After the petitioner comes out of custody and grant of default bail, the victim, the account holder, now registers a crime in Crime No.85 of 2025 for the very same offences that had been alleged by the Bank. 5. The complainant is different, but the fulcrum of the crime remains the same. In light of the petitioner being granted default bail and enjoying the liberty since then, it is just and proper to grant anticipatory bail to the petitioner. - 4 -

For the aforesaid reasons, the following:
O R D E R
This Criminal Petition is allowed and the petitioner is ordered to be released on bail in the event of his arrest in Crime No.85 of 2025 of CEN Police, Chikkamagaluru, pending on the file of the learned Principal Civil Judge (Sr.Dn.) and CJM Court, Chikkamagaluru, on the following conditions: i) The petitioner shall surrender himself before the Investigating Officer on or before 30.04.2026 and shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the concerned Investigating Officer;
ii) The petitioner shall not indulge in hampering the investigation and tampering the prosecution witnesses;
iii) The petitioner shall co-operate with the Investigating Officer to complete the investigation, and he shall appear before the Investigating Officer as and when called for;
iv) The petitioner shall not leave the jurisdiction of the Court without prior permission of the Investigating Officer, till the charge sheet is filed or for a

period of three months whichever is earlier; &
v) The petitioner shall appear before the jurisdictional police once in 15 days and mark his presence. vi) In the event of violation of any of the above terms, the above bail shall stand automatically cancelled. vii) The observations made above are only for the purpose of consideration of the application for anticipatory bail and the same shall not in any manner influence the trial. The trial Court shall consider the case on its merits and without being influenced by this order. Sd/- (M.NAGAPRASANNA) JUDGE
