JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 8 15-07-2026 Heard learned counsel for the parties. 2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 103 (1) of BNS, 2023. 3. As per prosecution case, marriage of informant’s sister Renu Devi was solemnized with Bhola Jha, S/o Late Ghuran Jha. About 35 years ago, her husband died. His sister was issueless. Further about six to seven years ago after the death of father-in-law of informant's sister, her in-laws namely Chandrakant Jha, Mohikant Jha, Kamalkant Jha, Hareram Jha, Bina Devi (petitioner), Lalit Kumar Jha, Raju Kumar Jha said her at the time of partition of property that there is no rule in their family to give share to the widow. Panchaiyati was held but she did not get any fruitful reply. At the time of partition, informant's sister demanded her share then accused persons abused and assaulted her. On 14.07.2025 in the night, co- accused Kamal Jha, and his wife Bina Devi (petitioner) administered her poison causing death. 4. Learned counsel appearing for the petitioner Patna High Court CR. MISC. No.6220 of 2026(8) dt.15-07-2026 2/2 submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. As a matte of fact, nobody has claimed to have seen the alleged offence committed by the petitioner. Only general and omnibus allegation has been leveled against the petitioner. No incriminating material has been recovered from the possession of the petitioner. Petitioner claims clean antecedent. 5. Learned counsel for the State opposed the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation that she along with other accused persons, administered poison to the sister of the informant causing her death with a view to grab her share, since she was issueless. Post mortem report reveals that death was caused due to asphyxia caused by smothering. 6.
