Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein. 3. By filing the present CMP application under Article 227 of the Constitution of India, the defendant No.7 in CS No.428 of 2003 pending before the learned Civil Judge (Senior Division), Bhubaneswar has approached this Court with a prayer for a direction to the learned trial court to expedite the trial in the suit and to dispose of the suit in a time bound manner. 4. Learned counsel for the Petitioner, at the outset, contended that the present Petitioner, who is the defendant No.7 in the suit, is aged about 68 years, has approached this Court for a direction to the learned trial court to dispose of the pending suit which was filed way back in the year 2003. He further submitted in the meantime though 23 years have passed, however, the trial of the Page 2 of 2. suit has not progressed substantially. He further contended that although the evidence from both sides has been concluded and the suit has been posted for argument, however, the suit has not been disposed of despite expiry of more than two decades’ time. 5. Taking into consideration the aforesaid submissions made by learned counsel for the Petitioner, this Court deems it proper to dispose of the CMP application by granting liberty to the Petitioner to move an application before the learned trial court seeking disposal of the suit. In the event, the evidence from both sides have been concluded and the matter has been posted for argument, the learned trial court shall pass necessary orders on the application of the Petitioner and make every endeavour to dispose of the suit as earliest possible. 6.
