Damodaran, Additional Public Prosecutor ORDER This Writ petition has been filed by the petitioner to issue a direction directing the 4th respondent to permit the petitioner to travel abroad to Dublin, Ireland for a period of 6 months from the date of departure from India. 2. The learned Senior Counsel appearing for the petitioner would submit that the petitioner is presently employed as a Vice President with Citi Bank of Dublin, Ireland and has been working there for several years. Owing to the pendency of the present dispute and the Look Out Circular which appears to be subsisting against her, she is unable to travel abroad to resume her employment duties. There are several family disputes between the petitioner and her brothers namely K.M. Vidhya Sagar and K.M. Vishnuvardhan in respect of family properties and TOS No.21 of 2023 on the file of this Court in respect of a Will dated 30.04.2021 is also pending. While pendency of the above said proceedings, the brother of the petitioner namely K.M. Vishnuvardhan had fraudulently attempted to alienate a major portion of properties by executing a Sale Agreement in the month of November 2021 without the knowledge of the https://www.mhc.tn.gov.in/judis WP Crl. No. 1169 of 2026 __________ Page3 of 8 petitioner, thereby, the petitioner filed a Suit in O.S. No.159 of 2023 before the Additional District and Sessions Court, seeking a permanent injunction and during the pendency of the same, an amicable settlement was attempted and a Family Arrangement dated 10.05.2024 was executed between the petitioner and her brothers. While so, due to non-performance of the above said settlement agreement dated 10.05.2024, the brother of the petitioner has lodged a false complaint against the petitioner and thereby a case in Cr. No.203/2025 for the offences under Sections 420, 294(b) and 506(i) of IPC, has been registered by the 3rd respondent police. Since the petitioner was working in abroad, a Look Out Circular was maliciously issued against the petitioner and after arrival to India on 22.12.2025, she came to know about the Look Out Circular and she was abruptly denied immigration clearance and unlawfully detained by the 4th respondent. Thereafter, the petitioner was handed over to the 3rd respondent and while she was in custody, she was served with a notice under Section 35(3) of B.N.S.S. to appear before the 3rd respondent on 22.12.2025 and she also appeared and they forced her to sign in documents. 2.1. The learned Senior Counsel would further submit that the petitioner was granted anticipatory bail by this Court vide order passed in Crl. O.P. No.34983 of 2025 dated 20.01.2026. Thereafter, the petitioner also filed a petition in Crl. O.P. No.2156 of 2026 challenging to quash the FIR and this Court directed the respondent police to investigate the matter and passed an https://www.mhc.tn.gov.in/judis WP Crl. Thereafter, the petitioner sent multiple representations to the respondents on 26.12.2025, 10.02.2026 and 08.05.2026 seeking permission to travel to Ireland, which have evoked no positive response. Now the petitioner received an official email communication dated 30.04.2026 from the employer to report duty on or before 20.05.2026. Therefore, the act of the respondents in keeping the Look Out Circular alive and preventing the petitioner from travelling abroad is arbitrary, illegal and violative of Articles 14 and 21 of Constitution of India. Therefore, the petitioner has filed this Writ petition and prayed to allow the petition by directing the 4th respondent to permit her to travel abroad for her employment purpose. 3. The learned Additional Public Prosecutor appearing for the respondents would submit that based on the complaint lodged by the defacto complainant, a case in Cr. No.203/2025 has been registered for the offences under Sections 420, 294(b) and 506(i) of IPC and now the case is under investigation. Since the petitioner was in abroad and not appeared for investigation, a Look Out Circular was issued and thereafter, she appeared for enquiry and considering the gravity of offences and pendency of case, the Look Out Circular has not been closed and hence strongly opposed to allow this petition. 4. In this case, there is a dispute between the petitioner and her family members with regard to the division of family properties and Civil Suits are also pending. In the meantime, the present case has been registered based on the complaint lodged by the brother of the petitioner. At that time, the petitioner was in abroad and thereafter, a Look Out Circular was issued against the petitioner and thereafter, the petitioner appeared before the Court and this Court also granted anticipatory bail in Crl. O.P. No.34983 of 2025 dated 20.01.2026. The petitioner has also filed a petition to quash the FIR and the same is also pending. 6. The main dispute is with regard to the division of the family properties and the matter is pending before the Court and already anticipatory bail was granted to the petitioner. While so, the pendency of the Look Out Circular is noway required and now the petitioner wants to go abroad for her employment purpose. If the petitioner is not joined duty on or before 20.05.2026, she has to face the consequences and she will loose her job opportunity and thereby, it is appropriate to allow this petition. In the meantime, if the presence of the petitioner is required before the Court, the petitioner can file appropriate petition before the trial Court to dispense with her personal appearance. The respondents also at liberty to approach the petitioner in the above said address for any interrogation purposes. In view of the same, the 4th respondent is directed to permit the petitioner to go abroad in accordance with law. 8. With the above directions, this Writ Petition (Criminal) is disposed of.
