Accused No.2 in Crime No.132/2026 registered by Kunigal Police Station, Tumkur for offences punishable under Sections 118(1), 115(2), 109 r/w 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.132/2026 was registered by Kunigal Police Station, Tumkur for the aforesaid offences against one Govinda and two others. In the said case, petitioner is arrayed as accused No.2. Apprehending arrest in the case, petitioner had filed Criminal Misc.No.605/2026 before the Jurisdiction Sessions Court, which was rejected on 27.04.2026. Therefore, he is before the Court. 4. Learned counsel for the petitioner submits that injured victims have suffered only simple injuries in incident in - 3 - HC-KAR NC: 2026:KHC:32611 CRL.P No. 6988 of 2026 question. Petitioner who is a youngster has no criminal antecedents. Accused Nos.1 and 4 who were arrested in the present case have been enlarged on bail. Petitioner is ready and willing to cooperate with the police for the purpose of investigation. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP who has opposed the petition, however, does not dispute the submission made by the learned counsel for the petitioner. 6. First information is submitted in the present case by Ramachandra who is one of the injured victims, on 11.04.2026 at about 16.40 hours, in respect of the alleged incident that had taken place on 10.04.2026 at about 22 hours. Accused No.1 - Govinda is the son of the first informant's elder brother. The incident in question had taken place after the parties had fought against each other in a Bar and Restaurant. In the said incident, undisputedly the victims have suffered only simple injuries. Petitioner has no other criminal antecedents. He has undertaken to cooperate with the police for the purpose of investigation. - 4 - HC-KAR NC: 2026:KHC:32611 CRL.P No. 6988 of 2026 7. Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.132/2026 registered by Kunigal police station for the offences punishable under Sections 118(1), 115(2), 109 r/w 3(5) of BNS, 2023 subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (One lakh only) with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:32611 CRL.P No. 6988 of 2026 3. Petitioner shall not tamper with the prosecution witness and he shall co- operate with the police for investigation and appear before them whenever called upon. 4.
