JUSTICE DEEPAK ROSHAN ----------- For the Petitioners : Mr. Prem Pujari Roy, Advocate For the Respondents : AC to AG ---------- 02/ 31.08.2026 The instant writ application has been preferred by the petitioners for following reliefs: (i) For issuance of an appropriate writ (s) / order (s) / direction (s) particularly a writ in the nature of certiorari quashing / suitably modifying Clause 6 of the Advertisement No. 01/2026, (JTGLCCE-2026, REGULAR) (Annexure-2), to the extent it fixes 01.08.2025 as the cut-off date for determining the age eligibility of the petitioners for computation of age, in the matter pertaining to making regular appointment on the post of Assistant Vector Borne Diseases Control Officer, and Inspector, Vector Borne Diseases Control Program, to be 01.08.2025; in parity, with similarly situated persons sought to be appointed under same advertisement, on the post of Junior Scientist Assistant (Sl. 8), who have been granted the benefit of age relaxation by fixing/computing their respective date of birth from the date as has considered at their initial/first appointment on contractual basis, whereas, the case of these petitioner stood victimized, for no justifiable/tenable, reason whatsoever. (ii) For issuance of an appropriate writ(s)/ order(s)/ direction(s) particularly in the nature of Mandamus to treat the petitioners at par with other set contractual employees like in the case of making regular appointment to the 2026:JHHC:26433 3 post of ANM/GNM initiated in terms of Advertisement no.03/2025, JANMCE- 2025 & Advertisement no.20/2023, JPMCCE-2023, wherein they have been awarded extra weightage / bonus marks for each no. of completed period of contractual service rendered by them from the date of their initial contractual appointment, whereas in the case of these petitioners neither relaxation in age has been granted, nor do they awarded any extra bonus marks even after taking continuous service for more than a decade, thereby discriminated the case of these petitioners, illegally and arbitrarily, for the reason best known to them. (iii) For issuance of an appropriate writ(s)/ order(s)/ direction(s) particularly in the nature of Mandamus to hold and to declare that the action of the respondents to be wholly illegal, arbitrary, and mechanical, in fixing such an uninformed cut of date to be 01.08.2025, in the matter pertaining to making regular appointment on the post of Assistant, Vector Borne Diseases Control Officer, and on the post of Inspector, Vector Borne Diseases Control Program; as the same impliedly amounts to ousting these petitioner from their service indirectly i.e. after taking a continuous service for nearly two decades on contractual basis; in the name of making regular appointment, which is otherwise directly in teeth of catena of Judgements passed by this Hon'ble Court, affirmed up to Hon'ble Supreme Court of India, wherein time and again it has been reiterated that a contractual employee appointed after following due procedure of law, shall only be replaced by making regular/substantive appointment on the post in question; and in the process of making such regular appointment, such contractual employee ought to be given adequate weightage, age relaxation and preference etc., at the time of making regular appointment; as such, applying the similar analogy, the respondent ought to have given same treatment; in par with benefits to other set of similarly appointed contractual employees i.e. in the case of Junior Scientist Assistant, (Sl. 8)who have been granted the benefit of age relaxation by fixing/computing their date of birth, from the date as has considered at their initial/first appointment on contractual basis, therefore there seem no defensible reasons to discriminate the case of the present set of similarly appointed contractual appointees like these petitioners, who are rendering continuous service, since nearly 2 decades. (iv) Further prays that ending disposal of the writ petition, permit the petitioners provisionally to submit their applications and participate in the selection process by granting age relaxation commensurate with the period of contractual service rendered by them, subject to the final outcome of the writ petition. 2. At the outset, learned counsel for the petitioners submits that instant application may be disposed of by giving liberty to the petitioners to approach concerned respondents, so that their grievances raised in the writ application can be redressed. 3. Learned counsel for the respondents submits that since counter- affidavit has not been filed, if the petitioners so wish, they may approach the concerned authorities for redressal of their grievances. 4. Having regard to the limited submissions of learned counsel for the parties, the instant writ application is hereby disposed of by directing the petitioners to file fresh representation(s) before the respondent No. 3. The moment the respondent No. 3 will receive any such representation; he shall 2026:JHHC:26433 4 take decision in accordance with law and applicable rules and regulations within a period of eight weeks from the date of receipt of such representation. This Court has not gone into the merits of the case. 5. As a result, the instant writ application stands disposed of. (Deepak Roshan, J.) 31st August, 2026 kunal/- Uploaded 08.09.2026
