Learned HCGP accepts notice for the respondents.
2. Heard Sri M.V.Seshachala, learned Senior counsel appearing on behalf of Sri Nagharish G.S., learned counsel appearing for the petitioner.

It is argued by the learned Senior counsel appearing for the petitioner that respondent No.2 has no jurisdiction to issue the impugned notice at Annexure-A and as such, invited the attention of the Court to the order dated 14.06.2017 passed by this Court in WP.No.25333/2017 & W.P.Nos.25460 to 25464/2017 (Annexure-K) and submitted that, the impugned notice is liable to be quashed.

4. Per contra, Sri. Spoorthy Hegde N., learned HCGP sought to justify the impugned notice stating that the notice has been issued by respondent No.2 as to clear the encroached area in the bordering village of Kaggalipura and specifying certain survey numbers and therefore, sought to defend the impugned notice at Annexure-A.
5. In the light of the submission made by the
learned counsel representing the parties, I am of the view that, since the notice has been issued by respondent No.2, is at preliminary stage, it is open for the petitioner to file reply/objection to the same, and the said reply/objection shall be filed within a period of two weeks from the date of receipt of copy of this order and thereafter, respondent No.2 shall consider the same in accordance with law and take decision in the matter accordingly.
6. It is also to be noted that, it is open for the petitioner herein to raise objection as to the jurisdiction of respondent No.2 to issue such a notice in their reply and

the same has to be considered by respondent No.2. Till the consideration of the reply that may be made by the petitioner herein, the respondents shall not interfere with the possession of the petitioner in respect of the subject land.
7. With this observation, writ petition is accordingly disposed of.
