JUSTICE DEEPAK ROSHAN ----------- For the Petitioners : Mr. Sankalp Goswami, Advocate For the Respondents : Mr. Varsha Ramsisaria, AC to GP-V ---------- 02/ 01.09.2026 By way of present writ application, the petitioners pray for a direction upon the respondents, particularly respondent No. 3, to immediately and forthwith grant approval to the appointment of petitioners which has been made against a vacant and sanctioned post and as the petitioners fulfil the eligibility criteria fixed by the State Government and after giving approval, fix the pay-scale of petitioner and pay salary thereto w.e.f. their initial date of joining i.e. 24.08.2024. 2. At the outset, learned counsel for the petitioners submits that though the petitioner joined the services at Guru Nanak High School, Sakchi, Jamshedpur, which is a Government Aided Minority School but till date the State Government has not given approval to their appointment, and hence, 2026:JHHC:26989 2 till date his pay-scale has not been fixed. He further submits that as per the existing policy of the State Government, the salary of teachers working in minority school are paid by the State Government at par with the Government teachers in the form of grant-in-aid. Learned counsel further submits that vide letters dated 27.08.2024 (Annexures-3 and 3/1), the Secretary, Guru Nanak High School, Sakchi, Jamshedpur has requested the District Education Officer, East Singhbhum, Jamshedpur for giving approval to the appointment of petitioners but till date the approval has not been granted. He accordingly submits that suffice it would be if this writ petition is treated as representation of the petitioners and a direction be given to the respondents to pass a reasoned order within a stipulated period. 3. Learned counsel for the respondents submits that since no counter- affidavit has been filed on behalf of respondents; as such, the petitioners may be directed to file fresh representation before the concerned respondents so that their grievance can be redressed. 4. Having regard to the aforesaid facts and circumstances and limited submissions of the learned counsel for the parties, the instant writ application is hereby disposed of by directing the Respondent No. 3 to treat this writ application as representation(s) and take a decision with regard to the claim made by the petitioners in accordance with law and applicable rules and regulations as well as in the light of Annexures-3 & 3/1, by passing a reasoned and speaking order within a period of 8 weeks from the date of receipt of a copy of this order. It goes without saying that if the decision is taken in favour of the petitioners, necessary consequential order be passed within a period of 2 weeks thereafter. 5. Petitioners are directed to serve a copy of this writ application to the concerned respondent so that their grievance can be redressed at the earliest. 6.
