CORAM : SRI JUSTICE CHALLA GUNARANJAN DATE : 13th February 2026 The Court made the following order:
The 3rd respondent filed counter affidavit, inter alia, stating that in pursuance to the direction issued by this Court, the writ petitioner has been found to be paid 80% of the retirement benefits, gratuity and encashment of earned leaves, against which an amount of Rs.8,21,117/-, Rs.35,537/- and Rs.6,87,447/- has been settled in favour of the petitioner. In view of the same, the respondents have pleaded to close the contempt case.

Learned counsel for the petitioner, however, states that amounts those that were settled in favour of the petitioner do not

completely satisfy the petitioners’ entitlement for retirement and pensionary benefits. In fact, the petitioner was short paid certain of these retiremental benefits and the petitioner is also entitled to be paid for the period of suspension. Therefore, it is urged that the orders of this Court have not been complied with in total.
3. It appears that respondents have already released the amounts, as mentioned specifically in the counter affidavit, and that the petitioner now has grievance with respect to certain heads of pay to which the petitioner is stated to be eligible and entitled. As this Court exercising contempt jurisdiction, cannot go into issue of quantum or heads of claim and decide whether the same was rightly settled, without expressing any opinion, the petitioner is granted liberty to claim amounts, if at all, otherwise entitled by resorting to appropriate proceedings.
4. With the above observation, the Contempt Case stands closed.
As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________________ JUSTICE CHALLA GUNARANJAN Date: 13.02.2026 ANS
