1. Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner No.1 is in custody since 01.12.2025 and petitioner No. 2 is in custody since 10.02.2026 in connection with Deoghar (Town) P.S. Case No. 188 of 2025 corresponding to S.T. Case No. 79 of 2026 for the alleged offence registered Section 126(2), 115(2), 308(5), 74, 76, 111(4), 3(5) of BNS and the charge has been framed under Section 126(2), 115(2), 74, 3(5) of BNS is pending in the court of learned Additional Sessions Judge-IX, Deoghar.

Learned counsel for the petitioners has submitted that the petitioners and the informant party have settled their dispute and the informant party is not interested in proceeding with the case. He has submitted that the informant and the victim have been examined before the learned court. The victim has turned hostile and the informant has also not fully supported the prosecution case. Learned counsel for the petitioners has produced the depositions of the informant and the victim before this Court. He has further submitted that the co-accused has been enlarged on bail by a co-ordinate bench of this Court in B.A. No. 7423 of 2025 vide order dated 28.08.2025.

Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail and has submitted that the petitioners have various criminal antecedents. However, the aforesaid
submissions made by the learned counsel for the petitioners are not in dispute.
5. To this, learned counsel for the petitioners has submitted that the petitioner No.1 is in custody since 01.12.2025 and the petitioner No.2 is in custody since 10.02.2026.

After hearing the learned counsel for the parties and considering the fact that the co-accused has been enlarged on bail earlier by a co-ordinate bench of this Court and the victim as well as the informant have already been examined before the learned court, the petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Deoghar in connection with Deoghar (Town) P.S. Case No. 188 of 2025 corresponding to S.T. Case No. 79 of 2026 on the following conditions: (i) The petitioners shall not disturb the informant party in any manner whatsoever. In the event of any such occurrence of disturbance, it shall be open to the informant party to move an application for cancellation of bail of the petitioners before the concerned court. (ii) One of the bailors would be the present pairvikar of the petitioners. (iii) The other bailor should be their close relative. (iv) The petitioners will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bonds furnished by the petitioners. (v) The petitioners will deposit a self-attested copy of their Aadhar Card along with their mobile numbers before the learned court which they will not change during the

pendency of the case without prior permission of the court. (vi) The petitioners shall fully co-operate with the proceedings before the learned court below.
7. The instant bail application is allowed with the aforesaid conditions.
8. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘FAX/E-mail’.
