Learned counsel for the appellants seeks leave to withdraw this appeal with liberty to the appellants to file a review petition. 2. Leave is granted with liberty as prayed for. 3. All contentions of the parties are left open. 4. However, we clarify that neither the pendency of this appeal nor the fact that the review is intended to be filed, should be construed as a liberty not to comply with the directions contained in the impugned order. This is because since 23.04.2024 without their being any interim relief from any Court, the State has chosen not to comply with the directions for payment of certain retiral benefits to the respondent No. 1. The liberty now granted should not be construed as any further licence for non-compliance. 5. Besides, it is always open to the appellant to comply with the directions contained in the impugned order without prejudice to 2026:JHHC:26827-DB 2 | P a g e their rights and contentions to challenge such orders by filing a review petition. 6. The present appeal is accordingly disposed of in the above terms. 7. All pending interlocutory applications are disposed of. 8. A copy of this order must be placed on the file of Cont.
