JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – husband is before this Court calling in question proceedings in C.C.No.3664/2024, pending before the II Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru, for offences punishable under Sections 498A, 109, 323 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioner – husband and respondent No.2 – wife in unison submit that during the - 3 - HC-KAR NC: 2026:KHC:31248 CRL.P No. 6406 of 2026 pendency of the subject petition, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions, have reunited and living together happily. An application under Section 320 r/w. 482 of the Cr.P.C., along with a joint affidavit is filed before this Court seeking permission to compound the offences. 3. The joint affidavit reads as follows: “JOINT AFFIDAVIT “1. We submit that, we are the legally wedded wife and husband their marriage was solemnized on 2.12.2021 “AHC” Kalvana matapam Kaliari town and Mandal, as per the Hindhu Religious and customs out of their wedlock a female daughter was born, subsequently the understanding was arose between us, therefore several proceedings were initiated against each other. it is further submit that out of the said proceedings the respondent No.2 herein has filed the criminal complaint at Varthur police station by virtue of her compliant respondent No.1 has registered in Crime. No. 242/2024 for the alleged offence under section (109, 498-A) along with offence under section 3 and 4 of Dowry Prohibition act 1961, subsequently the respondent No.1 has completed the investigation and filed the chargesheet for the offence under section 498-A, 109,323 of IPC 3 and 4 of Dowry prohibition act and order registered alleged chargesheet in CC No. 3664/2024 pending on the file IInd Additional Civil Judge Magistrate. 2. Apart from the criminal case filed by the respondent No.2 the petitioner herein has also filed the Divorce petition before the Family court at Bangalore in MC No. 29/2025 same is pending before the IIIrd Additional Senior Civil Judge Bangalore rural upon such the respondent No.2 has filed has also filed maintenance petition in MC No. 22/2024 and DVC No. 10/2025 both are pending on the file of Ist Class - 4 - HC-KAR NC: 2026:KHC:31248 CRL.P No. 6406 of 2026 Magistrate at Vayalpad, in the said proceedings the petitioner had appeared through his counsel and filed objections attributing allegations made by the respondent No.2, thereafter the trial was commenced at that juncture at the intervention of well wishers and friends including aid and assistance of the court at Vayalpad, we are realized our mistakes therefore now we both are agreed to withdraw the all allegations attributed against each other in the divorce case, as well as in the allegations dowry proceedings case including maintenance petition, therefore both of them mutually agreed to withdraw our allegations against each other, consequently we also agreed to withdraw our respective cases pending on files of concern courts within reasonable period of one week without causing any unwarranted delay for any reasons under such circumstances I have approched before this Hon'ble court to quash/close the 498 proceedings pending on the file of IInd ACIM at Bangalcre rural Bangalore in CC No. 3664/2024, and also we are agreed to live together henceforth without making any allegations against each other. 3. 3. We submit that the above said settlement as per our will and wish without there being any coercion, compulsion and undue influence, as per the settlement we have no objection to quash the criminal case in CC No. 3664/2024 filed as against the petitioner including against his mother and sister in the interest of justice.” In the light of the afore-quoted joint affidavit of the parties and that the parties have settled their matrimonial dispute and living together happily, though the offence alleged against the petitioner in the case at hand inter alia is one punishable under Section 498A of the IPC, as the allegations are not against the State, I deem it appropriate to accept the application and the joint affidavit and terminate the proceedings against the petitioner. - 5 - HC-KAR NC: 2026:KHC:31248 CRL.P No. 6406 of 2026 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.3664/2024, pending before the II Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru, stand quashed.
