By filing the present petition, the petitioner has prayed for following reliefs :- “10.1 That, the Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner; YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.07.08 18:20:31 +0530 2 10.2 That, the Hon'ble Court may kindly be pleased toissue appropriate Writ/Writs, direction/directions to direct respondent authority particularly Order/Orders Respondent No. 4 to remove the encroachment made by the private respondent no. 5. 10.3 That, the Hon'ble Court may kindly be pleased to issue Writ/Writs, Order/Orders and/or direction/directions to direct respondent authority to take action appropriate against the private respondents. 10.4 That, the Hon'ble Court may kindly be pleased to issue appropriate Writ/Writs, Order/Orders and/or direction/directions to direct private respondents to stop further encroachment. 10.5 Any other relief order or direction which may deem fit and just in the facts and circumstances of the case including the cost of the petition.” 2. Learned counsel appearing for the petitioner submits that he may be permitted to withdraw the present writ petition with liberty to file an appropriate application ventilating his grievance before the competent revenue authority, i.e., the Collector. It is further submitted that though an application has already been filed by the petitioner on 10.05.2024, however, the same is not in the prescribed proforma as required under the relevant provisions of law. 3. Learned State counsel has no objection to the prayer so made. 3 4. Accordingly, the instant writ petition is dismissed as withdrawn with liberty to the petitioner to file an appropriate application in the prescribed format before the concerned revenue authority, who shall consider and decide the same in accordance with law.
