JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in SC No.10/2025 pending before the Court of I Additional District and Sessions Judge at Chikkaballapura, arising out of Crime No.205/2024 registered by Manchenahalli Police Station, Chikkaballapura for offences punishable under Sections 126(2), 352, 351(2) and 103(1) of BNS, 2023 is before this Court, in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard learned counsel for the parties. 3. FIR in Crime No.205/2024 was registered by Manchenahalli Police Station, Chikkaballapura against the petitioner herein for the offence punishable under Section 103(1) of BNS, 2023 based on the first information dated 24.09.2024 received from Manjunatha C.K ., who is the nephew of deceased Ramanjinamma. In the said case, - 3 - HC-KAR NC: 2026:KHC:32257 CRL.P No. 4457 of 2026 petitioner herein was arrested on 25.09.2024 and remanded to judicial custody. After completing investigation charge sheet has been filed against him for the aforesaid offences. His bail application filed before the Trial Court in S.C.No.10/2025 was rejected on 10.06.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that deceased Ramanjinamma is the mother of the petitioner. Her husband, Thimmappa had died about 18 years prior to the date of the alleged incident and it appears that she had thereafter developed illicit relationship with CW3. Petitioner, who is a married man, allegedly had opposed the relationship of his mother with CW3 and he had also warned CW3 not to continue his relationship with his mother. He also allegedly had warned the deceased and CW3 Thimmaiah about dire consequences, in the event, CW3 comes to their house. 5. On 24.09.2024, when the petitioner came to his house at about 10.30 p.m., he found CW3 inside the - 4 - HC-KAR NC: 2026:KHC:32257 CRL.P No. 4457 of 2026 house with his mother, Ramanjinamma. He, therefore, got enraged and after abusing his mother and CW3, he allegedly pushed his mother to the ground and when she fell down, he assaulted her with a concrete stone and caused injuries. Immediately, thereafter, CW1 to CW3 had shifted Ramanjinamma to a hospital. But she was declared dead in the said hospital. The incident in question had taken place at about 10.30 p.m. on 24.09.2024, after the petitioner saw his mother with CW3, who is her paramour. Petitioner who got enraged, thereafter had abused his mother and CW3 and had pushed his mother Ramanjinamma and as a result, she fell down. Petitioner allegedly had picked up a stone which was lying nearby and had assaulted Ramanjinamma on her head and other parts of the body. Alleged incident appears to have taken place in a spur of moment, after the petitioner, who is the son of deceased, has seen his mother along with CW3 inside his house at about 10.30 p.m. on the alleged date of incident. - 5 - HC-KAR NC: 2026:KHC:32257 CRL.P No. 4457 of 2026 6. It is not in dispute that petitioner has no other criminal antecedents. He is a married man. Though he is in custody for the last more than 20 months, till date the trial in the case has not yet commenced. Prosecution has cited 34 charge sheet witnesses in the present case and therefore, the chances of the trial being completed and the case being disposed of in the near future is very remote. Under the circumstances, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.205/2024 of Manchenahalli Police Station registered for the offences punishable under Sections 126(2), 352, 351(2) and 103(1) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 6 - HC-KAR NC: 2026:KHC:32257 CRL.P No. 4457 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
