1. Learned counsel for the petitioner submits that fresh notice under Section 3 of the Jharkhand Public Land Encroachment Act,1956, has been issued against the petitioner by the Circle Officer, Gamharia. He refers to Annexure - 1 to the Interlocutory Application. 2. After going through Annexure - 1, I find that a notice has been issued to the petitioner under Section 3 of the Jharkhand Public Land Encroachment Act,1956 and a proceeding has also been initiated. 3. It is the case of the petitioner that he has appeared and filed his objection which is still pending and he has not been communicated with any order. 4. Considering the said submissions, since a notice has been issued to the petitioner and the petitioner has already filed his objection, it is expected that the objection of the petitioner will be considered and thereafter an appropriate order will be passed after hearing the petitioner in terms of the Jharkhand Public Land Encroachment Act, 1956. Without passing a final order, the respondents should not demolish the structure of the petitioner. 5. If any order has already been passed, the same should be communicated to the petitioner. 6. Petitioner will be at liberty to take appropriate steps if the order is passed against the petitioner. 7. Accordingly, this writ petition stands disposed of. 8.
