The petitioner has filed this petition seeking following relief (s) : “(a) This Hon'ble Court may kindly be pleased to call for the entire records from the possession of the respondents pertaining to the impugned order, dt. 17/05/2017 Annexure – P/8. (b) This Hon'ble Court may kindly be pleased -2- to issue a writ /direction to the respondents for quashing the impugned order, dt. 17/05/2017 Annexure - P/8. (c) May kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the respondents authorities for considering the claim of benefits of pay protection to the petitioner counting the previous service, pay and annual grade increment granted to him when he was working on the post of Shiksha Karmi Grade - III and Teacher [Panchayat]. (d) May kindly be pleased to allow the consequential benefits of services and pay with any other relief as the Hon'ble Court may be deemed fit and proper. (e) Cost of petition may be allowed. 2. Ms. Anguria, learned counsel appearing for the petitioner would submit that initially, the petitioner was appointed on the post of Shiksha Karmi Grade-III vide order dated 27.07.1998 and thereafter, he was granted regular pay scale with effect from 06.08.2002. It is contended that the petitioner was appointed to the post of Teacher (Panchayat) vide order dated 16.06.2005 and thereafter, he was selected and appointed on the post of Naib Tehsildar vide order dated 20.07.2016. She would contend that an application was moved by the petitioner for pay protection before respondent No.3, which was referred to the Collector, Finance Branch, District Raipur on 17.05.2017 but till date, no decision has been taken. She would contend that a direction may be issued to respondent No.2/Collector, District Raipur to decide the claim of the petitioner pursuant to letter dated 17.05.2017 within stipulated time. 3. On the other hand, learned Panel Lawyer appearing for the State/respondents would oppose the submissions. 3 4. Heard the learned counsel appearing for the parties and perused the documents placed on record. 5. Having considered the submissions advanced by Ms. Anguria, this petition, at this juncture, is disposed of with a direction to respondent No.2/Collector to decide the representation of the petitioner in light of letter sent by the Divisional Joint Director, Treasury Accounts and Pension Department, Raipur dated 17.05.2017 within a period of 90 days from the receipt of copy of this order. Respondent No.2 is directed to communicate the petitioner, if any decision is taken. 6. With the aforesaid observation(s)/direction(s), the present petition is disposed of.
