At the very outset, learned counsel appearing for the petitioners seeks permission of this Court to withdraw the present petition with liberty to file a duly constituted civil suit before the competent Civil Court claiming therein relief as per law. He would also submit that the petitioners may be permitted to move an application for grant of temporary injunction under Order 39 Rule 1 & 2 of the CPC. 2. No objection from other side. 3. Permission is granted. 4. Accordingly, the present petition is dismissed as withdrawn. However, the petitioners would be at liberty to file a duly constituted civil suit before the competent Civil Court claiming therein right over the property in question and at the same time they would be at liberty to file an application for temporary injunction. If the petitioners file a civil suit along with an application for temporary injunction before the competent Civil Court, it is expected that the concerned Civil Court shall consider their application for temporary injunction expeditiously.
