23.06.2026 Court No.28 Item No.34 Sc CRM (A) 1585 of 2026
In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Eco Park P.S. Case No. 0234 of 2025 dated 06.11.2025 under Sections 111(4) / 111(6) / 316(2) / 318(4) /61(2) of the BNS, 2023. And In the matter of: Subrata Bala ….Petitioner Mr. Ayan Basu, Adv. Mr. Sumit Routh, Adv.
…for the petitioner
Ms. Triparna Roy, Adv.
….for the State
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. He is CEO of the Company. The money went to the company’s account, not to his.
Learned counsel appearing on behalf of the State relies on the Case Diary and submits as follows. Huge sums of money were taken from the different victims for investment, but were defalcated. He relied on the statements of the victims, including that of the informant in the present FIR, as well as the statements of the other similar victims recorded before the learned Magistrate. An employee of the institution purportedly engaged to impart education, but who was allegedly inducing others to make investments was denied the benefit of anticipatory bail by an order dated 15.6.2026 passed by this Court in CRM (A) 1506 of 2026.
2 Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected.
Urgent photostat certified copies of this order be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
