For the Opposite Party/s : Mr.Narendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 3 15-07-2026 At the outset, learned counsel for the petitioners seeks permission to withdraw the prayer of petitioner No.2, Mithun Kumar @ Mithun Paswan, on the ground that the same has become infructuous as he has already been arrested. 2. Permission as prayed for is granted. Accordingly, the prayer of petitioner No.2 stands dismissed as withdrawn. 3. Heard the parties. Patna High Court CR. MISC. No.34797 of 2026(3) dt.15-07-2026 2/3
4. The petitioners apprehend their arrest in connection with Amba P.S. Case No. 33/ 2026 registered for the offence(s) punishable under Section(s) 115(2), 126(2), 117(2), 74, 109, 303(2), 352, 351(2) read with section 3(5) of the BNS. 5. Learned counsel for the petitioners submits that the allegations made in the FIR are totally false and fabricated, in fact, prior to the registration of the present FIR, the occurrence of assault had taken place against the petitioners and others by the prosecution party for which Amba P.S. Case No. 32/ 2026 was registered against the prosecution party and further, the present FIR has been registered against several persons but no specific allegation has been made against any of the petitioners.
It is further submitted that as per prosecution story, the accused persons, including the petitioners, firstly entered into the house of the informant and thereafter when they came out, some ladies standing upon the roof of the houses started pelting stones and bricks at the prosecution party resulting in injuries to the so- called injured persons, so, the specific allegation of pelting stones and bricks is not against the petitioners and the other allegations against them are general and omnibus in nature. 6. Learned APP appearing for the State has opposed the bail prayer of the petitioners and submits that several
Patna High Court CR. MISC. No.34797 of 2026(3) dt.15-07-2026 3/3 persons sustained injuries in the commission of the alleged occurrence in which two persons sustained grievous injuries. 7. Considering the seriousness of the occurrence which relates to assault committed with the prosecution party causing injuries to several persons including grievous injuries to two of them and with regard to the allegations levelled against the petitioners, the statements of the witnesses mentioned in paragraph nos. 17, 18 and 26 of the case diary are relevant and further, the case is under investigation, in my opinion, it is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, their prayer stands rejected. BKS/- (Shailendra Singh, J) U T
